The outdoor eating initiative began in 2020 under Mayor Bill de Blasio. During the pandemic, it saved the food business. Customers could still eat outside despite Covid-19 regulations. Restaurants were allowed to create eating facilities on roadsides and set up tables on pavements.

The bill, introduced by Councilwoman Marjorie Velazquez, passed 34 to 11. It replaces a 2020 temporary program that allowed companies to use sidewalks and streets year-round for outside dining. With this new arrangement, restaurants can keep doing this.

The temporary plan saved 100,000 jobs and companies during the pandemic, which Mayor Adams was grateful for. He claimed it also gave the city’s streets and walkways life and vigor. Restaurants must pay a fee based on their outdoor eating area and building size to comply with the new restrictions. The law simplifies organizing and following rules in outdoor eating areas.
